Terms & Conditions

These Terms and Conditions establish the legal agreement between you and Epashikino Resort & Spa regarding your booking, stay, and use of our services. By making a reservation or checking in, you agree to be bound by these terms.

1. Acceptance of Terms

By booking a room or service at Epashikino Resort & Spa, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, please refrain from making a booking. These terms apply to all guests, regardless of how the booking is made (online, by phone, or in person).

2. Booking and Reservation Terms

Eligibility

You must be at least 18 years of age to make a booking. By making a reservation, you represent that you are a legal adult with the authority to enter into binding agreements. Bookings on behalf of minors must be made by an adult who assumes full responsibility.

Reservation Confirmation

All reservations are subject to acceptance by Epashikino Resort & Spa. A booking is confirmed when you receive a confirmation email containing your booking reference number. Reservation availability is limited and subject to change without notice until confirmed. We reserve the right to reject or cancel any booking at our discretion.

Booking Accuracy

You are responsible for ensuring that all information provided during booking is accurate and complete. This includes your name, contact details, check-in/check-out dates, and number of guests. Inaccurate information may result in cancellation of your booking or additional charges.

3. Payment Terms

Pricing and Payment

All prices displayed on our website are in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated. Payment is due in full at the time of booking unless you have arranged a specific payment plan. We accept major credit cards, debit cards, bank transfers, and other payment methods as indicated during checkout.

Security and Payment Processing

Payment processing is handled through secure, PCI-DSS compliant payment gateways. We do not store your full credit card information on our servers. By providing payment details, you authorize us to charge your account for the booked services. All payments are non-refundable except as explicitly stated in our Cancellation Policy.

Additional Charges

Additional charges may apply for services beyond the standard room rate, including but not limited to: room service, spa services, dining, activities, laundry, mini-bar usage, and parking. These charges will be added to your bill and payable upon checkout.

4. Check-In and Check-Out

Check-In Time

Standard check-in time is 12:00 noon. Early check-in is subject to availability and may incur an additional charge. We recommend contacting us in advance if you require early check-in. Rooms will be held until 9:00 PM on your scheduled arrival date. Failure to check in by this time may result in cancellation of your reservation.

Check-Out Time

Standard check-out time is 10:00 AM. Late check-out is available at an additional charge of 50% of the nightly room rate per hour or portion thereof. All luggage and personal belongings must be removed from the room by the check-out time; any items left behind may be disposed of or held for a fee.

Identification Requirements

Valid government-issued identification is required at check-in. International guests must provide their passport or travel documents. Failure to provide valid identification may result in denial of accommodation and forfeiture of payment.

5. Guest Conduct and Facility Rules

Responsible Behavior

Guests must conduct themselves in a respectful and lawful manner. Any guest engaging in illegal activities, harassment, violence, or conduct that endangers others or damages resort property will be immediately evicted without refund. We reserve the right to contact law enforcement if necessary.

Noise and Quiet Hours

Quiet hours are observed between 10:00 PM and 9:00 AM. Guests must keep noise levels to a minimum during these times, including music, television, and conversations. Repeated violations may result in eviction.

Smoking Policy

Smoking is strictly prohibited in all indoor areas including guest rooms, hallways, restaurants, and common areas. Designated smoking areas are available as indicated on-site. Violation of this policy will result in a cleaning fee of KES 5,000 to KES 10,000 charged to the guest's account.

Pets and Animals

Pets are not allowed in guest rooms or common indoor areas unless prior written approval has been granted by management. Approved service animals are exempt. Violation will result in additional charges and possible eviction.

Prohibited Items

Guests may not bring weapons, explosives, or dangerous substances into the resort. No open flame candles, hot plates, or other fire hazards are permitted in rooms. Violation of this policy may result in immediate eviction and legal action.

6. Room Damage and Liability

Responsibility for Damage

Guests are responsible for any damage to rooms, furnishings, or resort property caused by their actions or negligence. Damage charges will be assessed and billed to the guest's account. Normal wear and tear is expected and not charged; however, intentional or careless damage will be charged at actual replacement or repair cost.

Liability Limitation

Epashikino Resort & Spa is not responsible for loss, theft, or damage to guest belongings, vehicles, or personal property while on resort premises. We strongly recommend using the in-room safe for valuables and not leaving items unattended in public areas. Theft or loss should be reported to management immediately.

Safe Keeping

Complimentary in-room safes are available in all guest rooms. The resort assumes no liability for valuables kept in rooms or elsewhere on the property. For high-value items, we recommend storing them in the front desk safe, though valuables stored at the resort remain the guest's responsibility.

7. Cancellation and Refund Policy

Please refer to our dedicated Cancellation Policy for complete details regarding cancellation timelines, retention fees, and refund procedures. The Cancellation Policy is incorporated into these Terms and Conditions. In summary:

  • 7 or more days before check-in: 10% retention fee, 90% refundable
  • 3 days before check-in: 50% retention fee, 50% refundable
  • Same day as check-in: Treated as no-show, 100% forfeited, 0% refundable

8. Accessibility and Special Requests

Accessibility Accommodations

Epashikino Resort & Spa is committed to accommodating guests with disabilities to the extent possible. Please notify us of any accessibility requirements at the time of booking. We offer accessible rooms and facilities as available. However, we cannot guarantee all accommodations for all disabilities.

Special Requests

Special requests such as room location, bed configuration, dietary requirements, and late check-out are subject to availability and cannot be guaranteed. We will make every effort to fulfill requests but reserve the right to modify or decline requests that cannot be accommodated. Requests should be made at the time of booking for best results.

9. Health, Safety, and Emergency Procedures

Health and Safety Compliance

Guests must comply with all health and safety regulations and emergency procedures. In case of emergency, guests must immediately follow instructions from resort staff and emergency personnel. Failure to comply may result in liability for any injuries or damages that result.

Medical Issues

The resort is not responsible for providing medical services. In case of medical emergency, we will contact emergency services on your behalf. Any associated medical costs are the responsibility of the guest. Guests with serious medical conditions should travel with appropriate medications and medical documentation.

Swimming and Water Activities

Swimming is at the guest's own risk. The resort provides lifeguard supervision during designated hours where applicable. Children must be supervised by adults at all times near water. The resort is not responsible for drowning, injuries, or accidents in or near water facilities.

10. Intellectual Property and Content

All content on the Epashikino Resort & Spa website and materials provided to guests, including photographs, videos, text, logos, and designs, are the intellectual property of the resort and protected by copyright. Guests may not reproduce, distribute, or use this content without explicit written permission. Photos or videos of guests may be taken by the resort for archival or promotional purposes; by checking in, guests consent to such photography in common areas.

11. Third-Party Services and Partnerships

Epashikino Resort & Spa may arrange or facilitate third-party services including tours, transportation, and activities through partner companies. These services are provided by independent contractors and are subject to their own terms and conditions. The resort is not responsible for the quality, delivery, or safety of third-party services. Disputes regarding third-party services should be directed to the service provider.

12. Dispute Resolution

Complaint Procedures

If you have a complaint or dispute regarding your stay or our services, please notify management immediately or contact us within 30 days of checkout. We will investigate your complaint and attempt to resolve the matter promptly.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kenya.

Arbitration

For disputes that cannot be resolved through direct negotiation, both parties agree to submit to binding arbitration administered by a mutually agreed upon arbitrator, to be conducted according to Kenyan arbitration procedures.

13. Modification of Terms

Epashikino Resort & Spa reserves the right to modify these Terms and Conditions at any time without prior notice. Changes become effective immediately upon posting on our website. Your continued use of our services following such changes constitutes your acceptance of the modified terms. We recommend reviewing these terms periodically for updates.

14. Entire Agreement

These Terms and Conditions, together with our Cancellation Policy and Privacy Policy, constitute the entire agreement between you and Epashikino Resort & Spa regarding your booking and stay. If any portion of these terms is found to be unenforceable, the remaining terms shall continue in full force and effect.
